
These Terms of Service (“Terms”) govern your use of the services provided by Sacramento Notary Co (“we,” “us,” or “our”), a mobile notary service operating in Sacramento and surrounding counties in California. By scheduling, booking, or using our notary services, you agree to these Terms in full.
Please read these Terms carefully before scheduling an appointment. If you do not agree with any part of these Terms, do not use our services.
1. Services Provided
Sacramento Notary Co provides mobile notary public services including but not limited to:
General Notarization
Acknowledgments, jurats, oaths and affirmations, copy certifications, and signature witnessing for personal and business documents
Real Estate & Loan Signing
Loan signings, refinances, HELOCs, purchase and sale transactions as an NNA-certified Loan Signing Agent
Estate Documents
Wills, trusts, powers of attorney, healthcare directives, POLST forms, and related estate planning documents
We are a notary public service only. We do not provide legal advice, prepare legal documents, or practice law. All document preparation should be handled by a licensed California attorney.
2. Scheduling & Appointments
Booking
Appointments are confirmed by phone, text, or email. A booking is not confirmed until you receive explicit confirmation from us. We reserve the right to decline any appointment request.
Arrival Window
We provide an estimated arrival time. Travel delays, traffic, or prior appointment overruns may affect arrival. We will notify you of any significant delay.
Same-Day & After-Hours
Same-day, evening, and weekend appointments are available at applicable rates and are subject to availability. Additional fees apply as disclosed at time of booking.
3. Cancellation & No-Show Policy
Cancellation
We ask for at least 2 hours notice for cancellations. For same-day appointments, cancellations with less than 1 hour notice may be subject to a trip fee if the notary is already in transit.
No-Show / Lockout
If we arrive at the scheduled location and cannot reach you or gain entry after a reasonable wait, a trip fee of up to $40 may be charged to cover travel expenses.
For loan signings coordinated through escrow or title companies, cancellation policies of the coordinating company may also apply.
4. Fees & Payment
Pricing
All fees are quoted prior to the appointment. California law caps the notary fee at $15 per notarial act (Gov. Code §8211). Travel fees, after-hours fees, and package rates are separate and disclosed upfront.
Payment Methods
We accept Cash, Check, Credit/Debit Card, Zelle, and Venmo. Payment is due at time of service unless prior arrangements have been made with an escrow or title company.
Receipts
A receipt can be provided upon request. For loan signings, billing is typically handled through the escrow or title company that scheduled the appointment.
5. Signer Requirements
To complete a notarization, all signers must meet the following requirements at time of appointment:
Valid ID Required
A current, government-issued photo ID is required: California Driver License, CA ID card, US Passport, or other ID accepted under Gov. Code §8220
Competency & Willingness
Signers must appear to be of sound mind, acting voluntarily, and not under duress. The notary reserves the right to refuse service if these conditions are not met.
Complete Documents
Documents must be complete with no blank spaces at the time of signing. The notary cannot notarize incomplete documents per California law.
If a signer does not have acceptable ID at the time of appointment, the appointment may need to be rescheduled and a trip fee may apply.
6. Refusal of Service
Sacramento Notary Co reserves the right to refuse or discontinue notarial services at any time if, in the notary’s professional judgment:
Legal Grounds
The signer lacks acceptable ID, does not appear competent or willing, the document appears fraudulent, or completing the notarization would violate California law or the Notary Public Code of Professional Responsibility
Safety Grounds
The notary’s personal safety is at risk, the environment is unsafe, or the situation presents circumstances that make completion of the appointment impractical or inappropriate
Refusal of service on legal grounds does not constitute discrimination and is a professional duty of the notary public under California law.
7. Limitation of Liability
Sacramento Notary Co acts solely as a notary public and witness to signatures. We are not responsible for the content, accuracy, validity, or legal effect of any document notarized. We do not verify the accuracy of statements made in documents or the legality of any transaction.
To the maximum extent permitted by California law, Sacramento Notary Co’s liability arising from any notarial act or service is limited to the fees paid for that specific appointment. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or violations of the California Notary Public statutes.
8. No Legal Advice
Sacramento Notary Co is not a law firm and does not provide legal advice. Nothing in our communications, website content, or services constitutes legal advice. We cannot advise you on whether a document is legally sufficient, what type of notarization you need, or how a document will affect your legal rights.
For legal advice regarding estate planning, real estate transactions, powers of attorney, or any other legal matter, please consult a licensed California attorney.
9. Governing Law
These Terms are governed by the laws of the State of California. Any disputes arising from or relating to these Terms or our services shall be resolved in the courts of Sacramento County, California. You consent to the personal jurisdiction of such courts.
Our notary services are governed by the California Government Code (Title 1, Division 1, Chapter 3 — Notaries Public), the California Notary Public Handbook, and applicable California law.
10. Changes to These Terms
We may update these Terms at any time. The current version will always be posted at sacramentonotaryco.com/terms-of-service/ with the effective date updated accordingly. Continued use of our services after any update constitutes acceptance of the revised Terms.
